TERMS AND CONDITIONS OF WORLD OF SPORTS EVENTS LIMITED LIMITED TRADING AS RED CIRCLE TICKETS ("REDCIRCLETICKETS")


The terms and conditions of sale of the tickets from Redcircletickets are set out below. Please read the terms and conditions carefully and note that by using Redcircletickets site you agree to and are bound by them:


These conditions apply to both the sale and any re-sale or subsequent assignment and apply in relation to any attendance at any event.

  1. Since event tickets are purchased in a free and fluctuating market prices are subject to change at any time. Foup-to-date, current prices please consult our web site.
  2. A confirmation receipt will be issued upon full payment.
  3. Recircletickets reserves the right to provide ticket upgrades at no extra cost to the purchaser.
  4. Tickets will be despatched using secure post delivering world wide.
  5. Redcircletickets will not be responsible for event postponements or event cancellations of any kind. This includes changes in event dates, event time, venue change and weather conditions. ALL TICKETS PURCHASED ARE FINAL.
  6. Redcircletickets is an independent, privately owned company engaged in the service of finding and providing tickets for admission to events world wide.
  7. Redcirceltickets is not affiliated with any box office.
  8. Payment for tickets will be accepted by WORLD OF SPORTS EVENTS LIMITED Ltd. All payments will be taken in AUD. This will also appear on your credit card statement.
  9. If you breach these terms and conditions, Redcircletickets reserves the right to prevent your future use of this web site, cancel your request, and/or take appropriate legal action against you.

THE PROVISION OF ENTERTAINMENT PACKAGES AND RELATED HOSPITALITY SERVICES BY REDCIRCLETICKETS ARE EXPRESSLY CONDITIONAL UPON THE BOOKING TERMS AND CONDITIONS SET FORTH BELOW (ALSO REFERRED TO AS THE "CONTRACT"). ANY TERMS AND CONDITIONS PROPOSED BY YOU IN ADDITION TO, OR IN CONFLICT WITH THESE BOOKING TERMS AND CONDITIONS ARE EXPRESSLY REJECTED BY REDCIRCLETICKETS.


No refund or exchange on any ticket shall be provided except as provided herein.


If a refund is made Redcircletickets may retain fee or charge.


Redcircletickets reserves the following rights:


To add, withdraw or reschedule a substitute artist and/or vary advertised prices, venue, seating arrangements and venue capacity;


To charge a fee for the replacement of tickets;


The right to admission is subject to the sellers and the venues terms of admission which are available from Redcircletickets on request. Late entry may result in non-admittance until a break in the performance;


Cameras, audio and video recorders may not be permitted. The right is reserved to broadcast on any event.


It may be a condition of entry to individual events to search of person and/or their possessions required at the time of the venue.


Entry may be refused if tickets are damaged or de-faced in any way or are not purchased from other authorised points of sale.

 

Charge Back

In the event that a credit card payment is debited to Redcircletickets account for whatever reason the purchaser shall indemnify and keep indemnified Redcircletickets from all losses, claims, costs or expenses whatsoever including interest and costs, arising from the charge back.

Change of Category

Whilst Redcircletickets may use its best endeavours to obtain the required ticketing for the particular seating and venue and time Redcircletickets reserves the right to change the category to another by upgrade or downgrade without monetary adjustment.

No Resale without Consent

Tickets may not without the prior written consent of Redcircletickets and the seller be resold or offered for sale at a premium (including via on-line, auction sites) or used for advertising, other commercial purposes including competitions and trade promotions or to enhance the demand for other goods or services either by the original purchaser or by subsequent purchaser, if the ticket is sold or used in breach of these conditions the ticket may be cancelled without reason and the bearer of the ticket may be refused admission.

Collection of Tickets

You must allow adequate time for collection or delivery of tickets, methods of collection and/or delivery will be available when you choose your collection/delivery details.

GST

GST will apply to all goods and services supplied via the site. Prices on this site include GST applicable.

Concessions

Where concessions are applicable, suitable and valid identification must be provided for collecting tickets and at the venue.

Pricing and Availability

Redcircletickets sells tickets on behalf of promoters, teams, bands and venues and resellers of those tickets, which means Redcircletickets does not set the ticket prices or determine seating locations. Tickets are generally sold through online. Tickets for popular events may sell out quickly. Occasionally, additional tickets may be available prior to the event. However, Redcircletickets does not control this inventory or its availability. Odd amounts of tickets cannot be guaranteed together, neither can sections nor rows (e.g. 3, 5, 7 tickets).

Cancelled Events

Occasionally, events are cancelled or postponed by the promoter, team, band or venue due to weather conditions or situations affecting the staff or audience. If an event is cancelled, please contact us for information on receiving a refund. If the event was moved or rescheduled, the venue or promoter may set refund limitations. Contact us for exact instructions.

Redcircletickets reserves the right to keep any booking fee applicable.

Refund Policy

Please check orders completely before completion as mistakes cannot be rectified at a later date.All orders are final. No monies refunded or tickets exchanged except in the event of the show/event being cancelled or at the discretion of Red Circle Tickets, in which case you will be refunded the full amount minus 50% administration fee.

Pricing and Other Errors

If the amount you pay for a ticket is incorrect regardless of whether because of an error in a price posted on the web site or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or presale date or you are to order a ticket that was not supposed to have been released for sale, then, Redcircletickets will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of this web site or other Redcircletickets operation system.

Limitations of Liability

Balls and other objects may fly into the spectator area during an event. Despite spectator shielding, injury can occur. Stay alert at all times before, during and after play or performance. If struck, immediately ask the usher for directions to a medical station. By purchasing a ticket through Redcircletickets you assume all risks incidental to the event for which a ticket is issued, whether before, during or after play or performance.

Ejection and Cancellation: No Redemption Value

Event Providers reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with Event Provider rules. Breach of terms or rules will terminate your licence to attend the event without refund. A ticket is a revocable licence and admission may be refused upon refunding the ticket?s face amount. A ticket is not redeemable for cash.

Recording

You agree not to record or transmit, or aid recording or transmitting, any description, account, picture, or reproduction of the event. You grant permission to utilise your image, likeness, actions and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) in any medium or context without further authorisation or compensation.

You Are Subject to Search

You and your belongings may be searched on entry. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, bundles and containers.

Accuracy of the Information

The sale or purchase of tickets to entertainment events is regulated by certain states and cities. You may be asked to provide information during processes you engage in on the Site. You represent and warrant that all information you provide will be true, complete and correct, and that you will update all information as it changes. You also acknowledge that complying with laws is your responsibility. If we are unable to verify or authenticate any information or tickets you provide during any registration, ordering, purchase, ticket posting, sale authentication, delivery, payment or remittance process, or any other process, or if we are no longer able to verify or authorise your credit card or bank account information, you may be prohibited from using the Site.

Privacy

We believe that your privacy and the privacy of all our users is important. Redcircletickets will not be responsible for otherwise liable for any use or disclosure of your contact information, or financial information, by a third party to whom Redcircletickets is allowed to disclose your contact information under the Privacy Policy. If you post any User Content to the Site, by electronic mail or otherwise, we will treat it as non-confidential and non-proprietary to you. Information that is posted to the Site shall not be subject to the Privacy Policy and may be publicly displayed and disclosed and otherwise used by Redcircletickets or any third party in any way. By posting User Content to the Site, you authorise us to use or allow others to distribute, reproduce, or otherwise use Such Content. You should not post information about yourself on the Site that can be used to identify or contact you, including, but not limited to, your name, home or work address, phone numbers, pagers, email address or other such information. If you post such information, Redcircletickets cannot prevent it from being used in a manner that violates these terms, the law, or your personal privacy and safety. By posting such information on the Site, you assume the risks and sole liability from the results of such posting. Redcircletickets is not liable for any lost data resulting from the operation of the Site or the enforcement of the Terms.

Copyright Policy

We will terminate the privileges of any user who uses this Site to unlawfully transmit copyrighted material without a licence, express consent, valid defence or fair use exemption to do so. In particular, users who submit User content to this Site, whether articles, images, stories, software or other copyrightable material, must ensure that the User Content the upload does not infringe the copyrights or other rights of third parties (including, but not limited, to trademark, trade secret, privacy or publicity rights). After proper notification by the copyright holder or its agent to us, and confirmation through court order or admission by the user that they have used this Site as an instrument of unlawful infringement, we will terminate the infringing users? rights to use and/or access to this Site. We may, also in our sole discretion decide to terminate a users? rights to use or access to the Site prior to that time if we believe that an alleged infringement has occurred.

Disclaimers

Redcircletickets does not promise that the site will be error-free, uninterrupted, or that it will provide specific results from use of the site or any content, search of link on it. Redcircletickets cannot ensure that files you download from the site will be free of viruses or contamination or destructive features. Redcircletickets disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose. Redcircletickets will not be liable for any damages of any kind arising from the use of this site, including all consequential damages.

Limitation on Liability

In no event, will Redcircletickets be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, or for lost profits, revenues or business opportunities, even if Redcircletickets has been advised of the possibility of such damages.

Indemnity

You agree to indemnify and hold Redcircletickets and its affiliates and each of Redcircletickets and its affiliates? respective officers, agents and employees, Contractors and principals, harmless from any loss, liability, claim or demand, including reasonable lawyers? fees, made by any third party due to or arising out of your use of the Site, including also your use of the Site to provide a link to another or to upload content or other information to the Site.

Caveat Emptor

This is a "caveat emptor" Contract that is the Purchaser purchases entirely at his/her or its own risk subject to the terms and conditions herein.

No Trust

The Purchaser hereby acknowledges that payments to Redcircletickets made may be in circumstances where the ticket has not been purchased and the Purchaser shall accept the risk that payments made without such purchase may result in loss to the Purchaser and that the monies are not held by Redcircletickets as trustee or in any fiduciary capacity or as partner or in any joint venture but merely pursuant to the terms and conditions herein.

Emotional Loss, Pain and Suffering

Redcircletickets will not be liable for any emotional loss, pain or suffering or emotional stress caused by any cancellation or alteration of any ticketing or any enforcement or breach of the terms and conditions herein.

Law and Construction

This Contract and these terms and conditions should be governed by the laws of Australia and enforceable in Courts of New South Wales and the purchaser hereby submits to the exclusive jurisdiction of the New South Wales Courts in all matters regarding these terms and conditions.

Prices - Reselling

Reselling is involved in relation to the sale of tickets by Redcircletickets. Redcircletickets prices will be different from the prices that may be specified on the tickets themselves and the buyer cannot derive any rights from these. All costs are included in Redcircletickets prices excluding shipment costs. Please call for the face value of the tickets.

Payment

Payment must take place using the method specified on Redcircletickets website or, as a departure from this, using a method to be further specified by Redcircletickets.

If paying by using credit card, the data shall be sent through a secure server. Redcircletickets shall request authorisation from the card issuer from the credit card.

If paying by a using credit card, the buyer must provide a copy of a valid credit card at the first request of Redcircletickets. Redcircletickets shall be entitled to demand from the buyer that said buyer use a different payment method than the one that has been selected.

Delivery of Tickets

Shipment and issue shall be at the expense and risk of the buyer.

Should the buyer not accept, pick up or have picked up a ticket sent to the said buyer, and the ticket is returned to Redcircletickets by FedEx or TNT Post, the buyer shall be deemed to be waiving his or her right to delivery. The buyer shall be obliged to compensate Redcircletickets for the costs incurred in relation to the return shipment.

Special provisions and Liability

When the occasion arises and in particular in relation to music and/or sporting events, tickets may display a name that does not match the name of the buyer or user of the ticket. Redcircletickets cannot be held liable should the buyer and/or the user of a ticket not be granted access to the event and/or he or she (and/or the person from whom said buyer has bought the (ticket(s)) is denied access as a consequence of this.

Redcircletickets shall not be held liable should organisers of an event at his or her own risk. Redcircletickets shall not be liable for damages that the buyer and/or user may suffer while travelling from or to the event attending such an event.

The quality categories specified by Redcircletickets for tickets may not harmonise with any categories used by the organiser of the event for which the tickets have been issued. The buyer cannot derive any rights from the category class and/or ranking.

The Buyer and/or user of a ticket supplied by Redcircletickets must obtain information himself in relation to instructions given by or on behalf of the organiser of the event or the authorities as well as changes with regard to the event such as starting times and similar. Redcircletickets shall not have any obligation to further inform the buyer and/or user of the ticket regarding this.

The content of the Redcircletickets website is without obligation and the buyer cannot derive any rights towards Redcircletickets in relation to the content thereof and the included links.

Redcircletickets prices are subject to fluctuations related to the demand for and the availability of tickets. The buyer cannot derive any rights from increases or reductions of prices once the buyer has accepted a Redcircletickets offer.

Lost, stolen or damaged tickets cannot be duplicated.

Redcircletickets can invoke force majeure should the Redcircletickets shortcoming be partly or fully the result of war, mobilisation, riots, flooding, fire, accidents, strikes, occupations, measures set by the government, non-delivery of required tickets to Redcircletickets by third parties and other unforeseen events.
